Disclosure a Document, Judge Salavati to Circumvent the Law

Majzooban Noor - The following document reveals one of the apparent violations of Judge Salavati concerning the case of the jailed Dervish lawyers while the mentioned Revolutionary Court judge has been recently acquitted by the judicial authorities of his violations.
After being acquitted by the court, afterward, Majzooban Noor Website decided to disclose the following document revealing one of the most apparent violations of judge Salavati, about changing of the title of the alleged charge of "membership in illegal groups" to "formation a group to disrupt the national security".

This alleged title change was carried out while the hearing session of the last defense from the Dervishes by the judicial interrogators had been held many months ago. It is vividly conspicuous this is to circumvent the law to prevent from their freedom and also to increase their conviction.
Head of Branch 15 of the Tehran Revolutionary Court carried out this act in line with the interrogators'requests to toughen penalties against the Dervishes and also to cover his continuing violations.
Because in the issued indictment from Evin Court, being a "membership in the Order of anti-security dervishes" was as one of the attributable charges to the Dervish prisoners, with regard to these charges the mentioned indictment according to the law of criminal procedure, so,the determined sentence minimum in law should have been terminated in December 2012, and the court should have freed the prisoners on bail in that time.

But Judge Salavati for refusal to release them, by changing the charge of "membership in group" to "formation the group" and also by transferring the Dervishes to the detention 209 of Ministry of Information, increased the minimum time of imprisonment in order to pave an appropriate bed to continue the illegal detention of Dervishes and to justify his continuing violations as well.

He announced that the mentioned alleged title in the indictment was merely an inadvertent mistake!, While, the final defense had been taken from the Dervishes according to the same previous charges.
The following document is a concrete proof and also the disclosure of violations of the judge of Branch 15, as the assistant prosecutor of Branch 1 in Evin, Mr. Khodabakhshi, through the letter No. 100239 dated December 28, 2011, addressed to the Department of Justice of Evin detention and emphasized frankly that their charge was "membershipin an illegal group ".

Therefore, the prosecutor's representative at the hearing session (was also Mr. Khodabakhshi), cannot justify that the charge in the indictment was an unintentional mistake.
