2006 Monday 27 NovemberDefense attorneys of imprisoned bus drivers’ union leader respond to judiciary chargesIran Press News: The regime-run website Roozna reported that in a letter, Mansour Osanlou’s lawyers, Parveez Khorsheed and Yousef Mowlaii responded to the Islamic regime’s justice minister and Judiciary spokesman’s charge against Osanlou. The regime’s judiciary claimed that Osanlou failed to observe his assurances [to the regime] and disregarded a summons sent sent by the judicial authorities. The letter explains the following items: On the first page of the November 22nd issue of Etemad’eh Melli newspaper the minister of justice raises the issues surrounding charges and the re-arrest of Mansour Osanlou. The mentioned charges are totally illegal and simply unjustifiable and therefore for the edification of the public and defending the legal rights of our client, we feel that the below points are worthy of printing: 1- The minister of justice and the speaker of the Judiciary have charged Osanlou with disregard for his assurances [to the regime] and the non-compliance with the regular scheduled reports to a judiciary branch; given that Mr. minister is a lawyer himself and any other lawyer as well as a large part of the public knows that these issues mentioned by the minister are no crime and Osanlou’s arrest is therefore illegal and in violation of constitutionality, citizen’s rights and the articles of the penal code since the crime, according to the the penal code, is the deed that determines the punishment. The grounds that have been communicated by the minister of justice do not merit punishment as the lack of presentation of the assurance to prove that assumption is in itself devoid of any penal bearing. 2- In the claim of the disregard to the citation and necessary summons, we are attempting to explain that with heavy the bail that Osanlou paid which is still in the judiciary’s escrow and given the fact that the legislator has determined the manner of summons which has not been observed. Therefore the minister of justice’s statements are not compatible with the current laws and is not in keeping with broadcasting of clear information and discovery of the truth. |
